Courts Clear Path to Water Tank Construction
Thursday morning an order was filed in Arizona Superior Court vacating the Preliminary Injunction filed in the case Ryan v Town of Carefree on August 25, 2020 and continued in effect by orders filed October 21 and December 16, 2020. The Town had filed a Motion to Vacate Preliminary Injunction on November 29, 2021 that was contested by various filings of the BHOA. Jay Ryan Adleman was the presiding Judge.
This decision has apparently cleared the way for construction to begin at any time as this injunction was the only court order preventing installation of a water reservoir on BHOA common land that had previously been condemned in a separate action, with Immediate Possession awarded to the Town.
